Governing lawItaly
1. Introduction and definitions
These Terms and Conditions (the "Terms") govern the use of the Trouvenir service ("Trouvenir" or the "Service"), which includes the iOS and Android mobile application, the website www.trouvenir.it, the artificial-intelligence features and the related editorial content. "User" means any natural person who accesses the Service, anonymously or authenticated. "Content" means texts, images, scans, reviews and other materials made available through the Service.
The Service is operated by Lorenzo Saraniti, owner of Trouvenir. This document is a binding contract between the User and the owner of the Service. Please read it carefully before using the Service.
2. Acceptance and changes to the Terms
Accessing the Service, including in anonymous mode, entails full acceptance of these Terms. Trouvenir may update the Terms at any time for technical, regulatory or service-evolution reasons. Changes take effect upon publication on this page; for material changes, notice will be provided through the app or by email to registered users. Continued use of the Service after changes constitutes acceptance of the new version.
3. Description of the Service
Trouvenir is a service dedicated to discovering typical Italian souvenirs and gastronomic specialties. It includes, without limitation:
Explore: editorial pages for cities, artisanal souvenirs and gastronomic products verified by Trouvenir.
Scan: an AI-based recognition feature that analyses images uploaded by the User to identify cultural and gastronomic objects.
Paths: in-depth editorial content of a cultural and gastronomic nature.
Passport/Profile: personal tracking of explorations, favourites, scans and usage statistics.
Paid (Premium) features available via in-app purchase, described in section 8.
Editorial content (city, souvenir, dish and path pages and their images) may be produced with the aid of artificial-intelligence tools (for example for drafts, summaries, translations and image generation), always subject to editorial verification and supervision before publication, with tracking of sources and provenance of materials. AI-generated images are treated as such for transparency purposes.
4. Account, registration and user tiers
The Service is accessible anonymously (guest session) or by registering with email, Apple ID or Google. Registration requires truthful and up-to-date data; the User is responsible for safeguarding their credentials and for any activity carried out through their account. Trouvenir provides the following tiers:
Anonymous/Free: limited access according to the published monthly thresholds (AI scans, Paths reading, quizzes).
Premium: unlimited access to capped features, according to the subscription terms.
Manager: access reserved for editorial curators authorised by Trouvenir.
The minimum age to create an account is 14. For users between 14 and 18, the consent of the holder of parental responsibility is required.
5. Acceptable use
The User undertakes to use the Service in compliance with the law, these Terms and good faith. In particular, it is prohibited to:
Circumvent or attempt to circumvent technical limits, usage thresholds, anti-fraud systems or security controls.
Upload images that are illegal, infringe third-party rights, are pornographic, violent or for which you lack publication rights.
Mass-extract, copy or reuse editorial content (scraping, mirroring, unauthorised reuse).
Use the Service for purposes other than personal and non-commercial, except under specific agreements.
Interfere with the operation of the Service, introduce malware or overload the infrastructure.
6. User-uploaded content
A User who uploads images or other content through the Service (for example for AI scanning) warrants that they own it or have the right to use it. The User grants Trouvenir a non-exclusive, royalty-free and revocable licence to process such content solely to provide the requested feature and prevent abuse. Images uploaded for scanning are not stored on our servers nor used to train artificial-intelligence models. No uploaded content will be made public without specific authorisation. The User can request the deletion of their content from the Privacy section of the app or according to the procedure indicated on the account deletion page.
7. AI scanning and recognition limits
The Scan feature uses third-party artificial-intelligence models to estimate the nature of the photographed subject and produce cultural and gastronomic information. Results are informational and do not constitute an assessment of authenticity, economic value or certified provenance. Recognition accuracy depends on image quality and factors beyond Trouvenir's control. The User must not use the results as the sole basis for purchase, investment or legal decisions.
8. In-app purchases, Premium subscription and renewals
The Premium subscription can be purchased via the Apple App Store (StoreKit) or Google Play (Play Billing). The price, duration (monthly or annual) and included features are shown at the time of purchase. The subscription renews automatically at expiry unless cancelled at least 24 hours before renewal from your account settings at the relevant store. Trouvenir does not handle payments directly: billing, refund and cancellation conditions are governed by the store's terms.
Apple App Store: manage the subscription from Settings › Apple ID › Subscriptions.
Google Play: manage from Play Store › Payments and subscriptions.
Any promotions, free periods or credits are subject to the specific conditions communicated at the time of the offer.
9. Right of withdrawal and digital content
For consumers, the Italian Consumer Code (Legislative Decree 206/2005) provides a 14-day right of withdrawal from the purchase of digital subscriptions. By activating the Premium subscription immediately, the User acknowledges and accepts that the supply of digital content begins before the end of the withdrawal period and expressly waives the right of withdrawal pursuant to Art. 59(1)(o) of the Consumer Code. Refunds for purchases made via the App Store or Google Play are handled directly by them, according to their respective policies.
10. Intellectual property
The trademark, logo, name, layout, source code, editorial content, photographs and database of the Service are owned by Trouvenir or its respective licensors and are protected by national and international copyright and industrial-property law. The User acquires no ownership of the content, but a personal, non-exclusive, non-transferable and revocable licence solely to use the Service. Reproduction, distribution or commercial use without written authorisation is prohibited.
11. Partner shops and B2B services
Some shops, artisans and producers are presented on Trouvenir as partners. The editorial presence of a shop does not imply an automatic commercial relationship nor a purchase by Trouvenir; information is published after editorial verification. Trouvenir may offer artisans and producers promotion, showcase or lead-generation services through separate contracts, governed by specific conditions that prevail to the extent relevant.
'Authenticity' or 'verified' indicators and shop scores are editorial and/or automated assessments based on publicly available sources at the time of analysis. They do not constitute official certifications, controlled-origin attestations (PDO, PGI or equivalent), legally binding quality guarantees or professional opinions. Assessments may change over time; affected businesses may request correction by writing to support@trouvenir.it.
12. Limitations of liability
The Service is provided "as is" and "as available". To the extent permitted by law, Trouvenir does not warrant:
The absence of errors, interruptions or delays in the operation of the Service.
The absolute accuracy of the results produced by AI scanning or of the editorial information.
The continued availability of prices, stock or services of the third-party shops mentioned.
The suitability of the Service for the User's specific purposes other than those stated.
Nothing in these Terms limits Trouvenir's liability for wilful misconduct or gross negligence, for personal injury, or for any other liability that cannot be excluded by law.
13. Suspension and termination of the account
Trouvenir may suspend or close an account in the event of a breach of these Terms, abuse or suspected fraudulent activity, with reasonable notice where possible. The User can delete their account at any time from the Privacy section of the app or by following the procedure described on the account deletion page. Closure does not entitle the User to a refund of ongoing subscriptions, except as provided by the stores' policies.
14. Privacy, cookies and personal data
The processing of personal data is described in detail in the Privacy Policy and the Cookie Policy, accessible from the links at the bottom of this page and from the site footer. The User confirms having read them before using the Service. The rights granted by the GDPR (Arts. 15-22) can be exercised as indicated in the policies or by contacting support.
15. Complaints and dispute resolution
The User can submit complaints by writing to support@trouvenir.it. In the event of a dispute with a European consumer, the European Commission's ODR platform (ec.europa.eu/consumers/odr) is also available for online dispute resolution.
16. Governing law and jurisdiction
These Terms are governed by Italian law. For disputes arising from the use of the Service, the court of the consumer's place of residence or domicile, if located in Italy, has jurisdiction, in accordance with Art. 66-bis of the Consumer Code. For non-consumer users, the court of Milan has exclusive jurisdiction.
17. Contact
For any request regarding these Terms, your account or the Service, you can write to support@trouvenir.it. Requests relating to privacy and the exercise of GDPR rights are handled as indicated in the Privacy Policy.
18. Prevailing language
This English text is a translation provided for your convenience. In the event of any discrepancy or interpretation doubt, the Italian version of these Terms and Conditions prevails.
